Pixactly Sports Analytics, hereinafter referred as ‘Pixactly’, ‘we’, ‘us’ or ‘our’ are committed to respect your privacy and choices. The privacy statement (hereinafter “Privacy Statement” or “Statement”) highlights our privacy practices regarding Personal Information that we collect and process in compliance to applicable data privacy regulations.

Objective

Through this privacy statement we intend to provide a synopsis of our privacy practices regarding Personal Information that we collect and process about you through various sources. Although the primary focus of this statement is on the data collected and processed through our websites, that link to this Privacy Statement, our adherence to the below mentioned principles remain across the organization towards personal data processing. Depending on the purposes of processing and your relationship with us as a data subject, we may provide additional customized privacy statements in the future.

The scope of this Statement covers the categories of personal data collected, how we use or process such data, who are the recipients of such data, and your associated rights under applicable laws including how to exercise the same. The applicability of the Privacy Statement is to the country of India and the website serves solely the people of India.

Wherever we may have provided the translation of our Statement in local languages, as per applicability, in case of a conflict between the local language and the English version, the English version shall prevail.

We collect data for verifying the identity and age of a person registering using aadhaar verification to ensure that minors’ registration is governed by a responsible adult. This verification does not involve storing, or retaining access to, the applicant’s Aadhaar number.
We also collect acceptable relationship documents to ensure satisfactory examination of the adult’s claim of legal guardianship of the minor.

1.4.1 We process your Personal Information when it is necessary for the performance of a contract to which you are the party or in order to take steps at your request prior to entering into a contract, e.g., when you would engage with us for receiving our services and offerings, or when managing the data of our employees for ensuring the performance of their employment contract.

1.4.2 We process your Personal Information when it is necessary for the purposes of a legitimate interest pursued by us or a third party (when these interests are not overridden by your data protection rights), e.g., when we need to ensure that, if you are a minor, your usage of our website and consumption of our services is under the supervision of a responsible adult declaring themselves as your legal guardians.

3.1 Pixactly does not share your Personal Information with third parties for their direct marketing purposes.

3.2 Facilitating International Data Transfers:

We may transfer Personal Information to countries outside of India, either within Pixactly or to third parties, including to countries which have different data protection standards from those which apply in India.

When we transfer your data outside India, we will take reasonable and appropriate steps in accordance with applicable laws to ensure its protection. For transfers between Pixactly, we rely on binding LLP rules to safeguard your Personal Information. Where data is processed by third-party providers or partners acting as data processors, we implement Standard Contractual Clauses and, where appropriate, rely on applicable legal derogations to facilitate such transfers.

When required, Pixactly may disclose Personal Information to external law enforcement bodies or regulatory authorities, to comply with legal obligations.

4.1 Subject to the laws of India, you may have rights as a data subject (including but not limited to right to information, access, rectification, erasure, object, restriction of processing, right to complain), relating to your Personal Information that we process. Where the data processing is based on your consent, you may withdraw your consent to the processing of any Personal Data at any time. This will not affect the lawfulness of any processing operation before your withdrawal.

At Pixactly, there exists a perfect balance between Governance, Process and Technology, the combination of which has established Pixactly's commitment to its customers and stakeholders. Pixactly adopts reasonable and appropriate security controls, practices and procedures including administrative, physical security, and technical controls in order to safeguard your Personal Information.

Personal Information will not be retained for a period more than necessary to fulfill the purposes outlined in this privacy statement unless a longer retention period is required by law or for directly related legitimate business purposes. Personal Data that is no longer required to be retained as per legal and business requirements will be disposed in a secure manner.

We are committed to complying with applicable privacy and data protection laws and regulations in the jurisdictions in which we operate. Pixactly might provide links to third-party websites and services. However, Pixactly is not responsible for the privacy statements, practices, or the contents of such third-party websites.

10. Children’s Privacy

Pixactly, its associated products or services and hosted contents, are not intended for use by children without supervision of an adult guardian. Where a child is registered as a swimmer on our platform, this occurs exclusively through our guardian-registration process: the registering adult must complete Aadhaar-based identity and age verification and submit supporting documentation establishing their legal guardianship of the child before the child’s profile is activated.

We do not knowingly solicit or collect personally identifiable information online from children without prior verifiable parental/guardian consent. If Pixactly learns that a child has submitted personally identifiable information online without parental consent, it will take all reasonable measures to delete such information from its databases and to not use such information for any purpose (except where necessary to protect the safety of the child or others as required or allowed by law).
